Work Highlights

• Shaofei Cheng represented Guilin Shuguang Real Estate Development Company, Dayawan Branch in a contract dispute enforcement case against Huizhou Aodeli Industrial Co., Ltd. He engaged in procedures such as objections to the enforcement and reconsideration on behalf of Guilin Shuguang Real Estate Development Company, Dayawan Branch, the judgment debtor. Ultimately, the Supreme People’s Court, through its chief justice discovery procedure, lawfully ordered a retrial of this case. This action corrected a miscarriage of justice in a case that had seen its judgment stand for 10 years and had been under enforcement for 10 years.
• Shaofei Cheng represented Zhejiang Kunlun Construction Group Co., Ltd., the appellant, in the second-instance case of the construction contract dispute involving Anhui Wenyue Investment & Real Estate Co., Ltd., the Department of Culture and Tourism of Anhui Province, and the Department of Culture of Anhui Province Service Center. The case, involving principal amounts exceeding RMB 40 million, was accepted for a second-instance trial by the Supreme People’s Court. Despite the initial ruling by the Higher People’s Court of Anhui Province that the Department of Culture and Tourism of Anhui Province and the Department of Culture of Anhui Province Service Center bore no responsibility, His representation in the second-instance litigation led to the Supreme People’s Court’s final ruling in favor of Zhejiang Kunlun Construction Group Co., Ltd., the appellant. The court overturned the original ruling, holding the Department of Culture and Tourism of Anhui Province and the Department of Culture of Anhui Province Service Center jointly liable. He safeguarded his client’s legal rights and interests, fulfilling the objectives of his representation with distinction.
• In the case where the “Benxi Huaxia Real Estate Comprehensive Development Limited Liability Company Project” represented by Shaofei Cheng on behalf of China Cinda Asset Management Co., Ltd., Liaoning Provincial Branch, had been at a standstill for four years, essentially rendering it a “dormant case”, Shaofei Cheng's diligent efforts ultimately led to the higher court lawfully escalating the enforcement of the case. The higher court intervened to remove any obstructions, and issued a direct order for the recovery of assets, reviving the case from a standstill.
• In the “Financing Lease Project for Sinagri YingTai Linzhou Bio-tech Park Co., Ltd.” represented by Shaofei Cheng on behalf of Great Wall Guosing Financial Leasing Co., Ltd., Shaofei Cheng, through three years of diligent efforts, successfully facilitated a debt transfer agreement between Great Wall Guosing Financial Leasing Co., Ltd. and a third party not involved in the case. This agreement enabled Great Wall Guosing Financial Leasing Co., Ltd. to recover a lump sum of RMB 200 million in cash, fulfilling the objectives of his representation with distinction.
• Shaofei Cheng represented Great Wall Guosing Financial Leasing Co., Ltd. in the “Baoneng Project”, involving a subject amount of RMB 1.2 billion, for which effective legal documents have been obtained.
• The “Shenyang Holland Village Bankruptcy Project” represented by Shaofei Cheng on behalf of former China Great Wall Asset Management Co., Ltd., Shenyang Office (currently known as China Great Wall Asset Management Co., Ltd., Liaoning Provincial Branch), successfully secured a recovery of up to RMB 460 million in cash for China Great Wall Asset Management Co., Ltd., Shenyang Office.
• In the “Debt Recovery Project of NFC Shenyang Metallurgical Machinery Co., Ltd.”, represented by Shaofei Cheng on behalf of the China Great Wall Asset Management Co., Ltd., Shenyang Office, Shaofei Cheng's diligent efforts led to a lump sum recovery of RMB 92.05 million in cash during the litigation phase for China Great Wall Asset Management Co., Ltd., Shenyang Office, fulfilling the objectives of his representation with distinction.
