Work Highlights

• Handled hard cases with significant influence, or cases in which the agency opinions were adopted, major changes were made to the original sentence, and heavy losses were recovered for the parties, as well as many criminal cases in which the criminal innocence defense and the change of determination on nature were successful. The typical cases are as follows:
• The case of an Industrial Co., Ltd. in Zhengzhou v. a branch of the Industrial and Commercial Bank of China in the contract dispute, which was tried by an intermediate people's court; this case is a difficult case involving criminal and civil cases; recovered the loss of RMB 30 million for the bank.
• Represented a rural credit cooperative association in Jiaozuo city in the bill dispute appeal case against a materials limited company; in the circumstance of losing all the cases in the first instance, the Higher People's Court rejected all the claims of the materials limited company in the second instance, recovering the loss of RMB 12 million for the rural credit cooperative association.
• Represented a real estate development limited company in the contract dispute with a construction development limited company; applied for retrial in the circumstance that both the first instance and the second instance lost the case. After that, the Higher People's Court ruled that the judgments of the first instance and the second instance were revoked and the case was sent back to the court of first instance for retrial. After retrial, both the court of first instance and the court of second instance ruled that the claims of Taihong Company were rejected, recovering the loss of more than RMB 100 million for a real estate development company.
• Represented a municipal government in the administrative litigation against seven individuals including Yong X Zhang and XX Wei in an intermediate people's court and a high court in the first instance and the second instance, which was a case of great influence. Both the intermediate people's court and the high court decided to dismiss the plaintiff's lawsuit;. 
• Represented an automobile sale service limited company in appellate administrative litigation against a provincial government; in the circumstance of losing the case in the first instance, the second instance judgment of the High Court revoked the administrative judgment of the first instance, and at the same time revoked the relevant administrative reconsideration decision of a provincial people's government;.
• Represented eight individuals including X Li in appellate administrative litigation against a development management committee. The first instance lost, all the decisions of the first instance were reversed in the second instance, and recovered significant losses for the relocated households.
• The case of X Sen Fan v. the people's government of a district for violation of laws by administrative acts tried by the Supreme People's Court in the second instance; this case has a great influence on the government's demolition behavior.
• The case of in which Li, a director-level prosecutor of a provincial people's procuratorate, was charged with bribery tried by an intermediate people's court. 
• The case in which a police officer X Li charged with bribery tried by an intermediate people's court; this case was a case with great social impact.
• Defended the defendant  X Zhao against charges of organized crimes, extortion and casino gambling. This case is a major case of eliminating evil in a province. After the appeal, the defendant's term of imprisonment was reduced by three years and six months in the second instance.
• Defended the innocence of X Zheng, a department level cadre of a group company, who was suspected of taking bribes and embezzling public funds; the court found that the public prosecutor's accusation of accepting bribes was not established;
• Defended XX Gao's innocence for the crime of embezzlement and misappropriation of funds; the court ruled that the charge of duty embezzlement by the public prosecution agency was not established, and the second instance upheld the original judgment after the procuratorate protested;.
• Defended XX Zhang's innocence against a charge of rape. The court dismissed the charge of rape, and sentenced XX Zhang to an imprisonment of eight months for forcible indecency according to the principle that the sentence of judgment is equal to the sentence of detention of the party concerned.
• In the case of a criminal suspect's loan fraud, commissioned as early as the investigation stage by the client; the defense opinion held that the crime did not constitute the crime of loan fraud with a minimum sentence of more than ten years, and should be punished according to the crime of defrauding loans with a lighter maximum sentence of less than seven years, and then the court sentenced the client to three years in prison according to the crime of defrauding loans.

• Provided full legal services for the corporate restructuring of a whole people-owned enterprise in Zhengzhou;
• As a legal adviser of a financial bureau, provided legal services for its major projects;
• Issued a legal opinion for a medical college in Henan;
• Provided legal advice for a large state-owned enterprise in Henan with respect to the equity transfer;
• Issued legal opinions for the restructuring of a subordinate enterprise of SASAC of a place;
• Participated in the declaration of bankruptcy claims for a large state-owned bank;
• Issued a due diligence report for the transfer of non-performing assets of a large state-owned bank.

• Made legal reports for colleges, secondary schools and primary schools in the jurisdiction for many years as the legal adviser of Zhengzhou Education Bureau and a member of the Lawyers' Group of Zhengzhou Primary and Secondary School Students' Rights Protection Center; 
• Served as the deputy head and senior lecturer of the Henan Provincial Advisory Expert Presentation Group of the National Youth Legal Education Activity Office, and made legal reports for teachers and students of primary and secondary schools;
• Provided legal aid services to the employees of the enterprise trade union in the jurisdiction as a member of the Zhengzhou Workers'  Legal Aid Lawyer Team appointed by the Zhengzhou Judicial Bureau of the Zhengzhou Municipal Federation of Trade Unions.
